St. Louis County judge denies restraining order against Sheriff Montgomery

ST. LOUIS, Mo. (First Alert 4) - A St. Louis County judge has declined to issue a restraining order against St. Louis City Sheriff Alfred Montgomery.

Montgomery’s former deputy, Darryl Wilson, asked the judge to grant a restraining order, alleging a trend of harassment. Wilson now works for the St. Louis County Sheriff’s Office.

Wilson alleged that Montgomery had shown up at his new jobs twice since he left the St. Louis City Sheriff’s Office. The most recent incident happened on April 16.

On Monday, Montgomery took the stand, stating he was visiting St. Louis County Sheriff Scott Kiefer about Wilson allegedly horse-playing in city government buildings with a firearm on his person and recruiting city deputies to the county.

Wilson’s attorney Bobby Bailey told First Alert 4 Investigates that Sheriff Montgomery’s team “misrepresented facts” in court on Monday.

The judge declined to issue the restraining order because Wilson’s allegations were not proven, according to the court document.

The St. Louius Sheriff’s Office issued the below statement after the judge’s decision on Wednesday:

“The St. Louis Sheriff’s Office acknowledges that today, a judge denied a petition for an order of protection filed by a former deputy against Sheriff Alfred Montgomery. The court ruled that the petitioner’s claims lacked merit as no credible evidence was presented to the allegations.

Today’s ruling demonstrates that our judicial system continues to function as designed, evaluating the facts rather than unsubstantiated claims.

As an office tasked with serving legal process under the Missouri state constitution, which includes responsibilities under the Adult Abuse Act, we recognize the importance of the court’s careful examination of petitions for order of protection based on factual evidence.

Our office remains focused on our mission to serve the citizens of St. Louis with honor, integrity, respect, and a dedication to justice.”

Wilson was the former sheriff’s deputy who told First Alert 4 was turned over to the FBI for investigation.
