WASHINGTON (Gray DC) - In a 6-page filing Monday, Special counsel Jack Smith announcing he is seeking a dismissal of President-elect Donald Trump’s 2020 election subversion case. He is also moving to dismiss the Florida documents case.

In the filing, Smith clarified “This outcome is not based on the merits or strength of the case against the defendant.”

The move marks ANOTHER political victory for Trump, who vowed to fire Smith his first day in office.

In a statement, Trump Communication Director Steven Cheung called the decision “a Major victory for the rule of law,” adding “The American People and President Trump want an immediate end to the political weaponization of our justice system.”

Smith and Trump are both in unchartered territory with this one -

Never before has an incoming president faced criminal charges.

As the law stands, a sitting President is immune from prosecution.

Also Noteworthy - the Supreme Court’s decision this summer to grant Trump presidential immunity for his alleged crimes that happened while in office.

The fate now of President-elect’s two state cases, one in New York and one in Georgia, remains to be seen.
